Caution on Article 25 Mass CEC Wind Turbine Funding- Is It Legal ?   

The Falmouth wind turbine are breaking the Massachusetts state noise regulations 310 CMR 7.10   The Massachusetts Superior Court has an injunction against the turbines as they are a nuisance.  

One simple question: Can you rewrite a contract on something you know is breaking the law ?

The Massachusetts Clean Energy Center has offered to renegotiate the wind turbine contracts in Falmouth.

The Town Meeting Members have to ask first if the Mass CEC is breaking their own rules.

The Massachusetts Clean Energy Center has admitted that they were mistaken placing megawatt turbines too close to residential homes which include Falmouth. What kind of legal bid will the Town of Falmouth be in knowing set backs should be at least 2000 feet today when they sign a new contract.  

Nils Bolgen the program director and facilitator of Falmouth Wind  1 & 2 from the Massachusetts Clean Energy Center has changed the setbacks of the commercial wind turbines to 2000 feet in May of 2013.   Based of the catastrophic health and finance issues in Falmouth the setbacks may be increased even more during 2014.  

Nils Bolgen Quote: "Now, all turbine proposals within 2,000 feet of residences must provide that data."  

Laurel Carlson of the Massachusetts Department of Environmental Protection commented on possible changes to the  approved methods of noise testing commercial wind turbines.
